In the third instalment of the Howard Kennedy trainee's decade review, I reflect on recent developments regarding adjudication.
The Housing Grants, Construction and Regeneration Act 1996 introduced adjudication to the construction industry. In short, adjudication is a dispute resolution method specifically for construction contracts which aims to resolve disputes quickly and maintain the relationship between the parties. Here I discuss two interesting cases which have provided insight and guidance on what happens when a referring party is insolvent.
